A major court ruling in Paris surrounding attempts to block the sale of Nintendo DS flash cartridges in France has gone against Nintendo in favour of the Divineo Group.

The judge ruled that by blocking the use of non-Nintendo carts the company was deliberately locking out developers from their. He reported said that Nintendo, "should be more like Windows where anyone can develop any application if they wish to."

Maxconsole, a site run by Max Louran of Divineo, wrote: "Developers should not actually require separate development kits and should just be able to develop applications as they wish on retail versions of Nintendo's consoles."

The ruling essentially means that flash carts are now safely legal across Europe.

Full court documents will be available on Maxconsole soon.

Happy hacking.
